You may not: (a) use automated systems to access the platform; (b) attempt to gain unauthorized access to any portion of the platform; (c) interfere with or disrupt the platform or servers; (d) transmit viruses or malicious code; (e) impersonate any person or entity; (f) harvest user information without consent.
Any content you submit must not be unlawful, threatening, abusive, defamatory, obscene, or otherwise objectionable. You must not post content that infringes intellectual property rights, violates privacy, or contains false or misleading information.
All content, features, and functionality on Witnessly, including but not limited to text, graphics, logos, software, and algorithms, are owned by Witnessly and are protected by international copyright, trademark, and other intellectual property laws.
By submitting content to Witnessly, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display such content for the purpose of providing and improving our services.
You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material from our platform without our prior written consent, except as permitted by these Terms.
Witnessly provides a platform for connecting users with legal professionals. We offer various service tiers with different features and pricing. Detailed information about each tier is available on our pricing page.
Fees are charged as specified in your subscription plan or service agreement. All payments are processed securely through our payment processors. You agree to provide current, complete, and accurate payment information for all purchases.
Refunds are handled on a case-by-case basis and are generally available within 14 days of purchase for subscription services, provided no substantial use has been made of the service. Professional service fees are subject to the policies of individual professionals.
Witnessly is a platform for connecting users with legal professionals. We do not provide legal advice, and no attorney-client relationship is created through the use of our platform. Any information obtained through Witnessly should not be considered legal advice.
We strive to maintain continuous availability but do not guarantee that our platform will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue any aspect of the platform at any time without notice.
While we verify professional credentials, we do not guarantee the quality, competence, or suitability of any legal professional on our platform. Users are responsible for conducting their own due diligence and making informed decisions about which professionals to engage.
To the maximum extent permitted by law, Witnessly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid to Witnessly in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.
You agree to indemnify, defend, and hold harmless Witnessly and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the platform or violation of these Terms.
You may terminate your account at any time by contacting our support team or through your account settings. Upon termination, your right to use the platform will immediately cease.
We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms, fraudulent activity, or if we believe your actions may harm our users or business.
Upon termination, all licenses and rights granted to you will immediately cease. We may retain certain information as required by law or for legitimate business purposes. Provisions that by their nature should survive termination will remain in effect.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Witnessly operates, without regard to its conflict of law provisions.
Any dispute arising from these Terms or your use of the platform will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if your claims qualify.
You agree that any arbitration or proceeding shall be limited to the dispute between you and Witnessly individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.
These Terms constitute the entire agreement between you and Witnessly regarding your use of the platform and supersede all prior agreements and understandings, whether written or oral.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms or any rights hereunder without restriction. Any attempted assignment in violation of this provision is void.
